General Terms and Conditions
§1 Scope of application
These General Terms and Conditions apply to all contracts concluded with the Landgasthof Hotel Linde.
§ 2 Conclusion of contract, contracting parties
1. The contract is concluded between the customer and the Landgasthof as soon as the reservation has been confirmed in writing by the Landgasthof. The conclusion of the contract obliges both contracting parties to perform it. Option dates are binding for both contracting parties.
2. Option dates are binding for both contracting parties. If the agreed option date is exceeded and the reservation is not confirmed in writing, Landgasthof Hotel Linde reserves the right to cancel the option and to rent the rooms to others.
§ 3 Services, prices, payments, complaints
1. The customer is obliged to pay for the services used by him or the agreed prices of the Landgasthof. This also applies to services and expenses incurred by the customer for third parties on behalf of the Landgasthof.
2. Reserved rooms are available to the client only for the time agreed in writing. Use of the premises beyond the agreed period requires prior approval by the hotel management and may be charged.
3. All prices are in Euro and include statutory value-added tax. If the period between conclusion of the contract and provision of the services exceeds 120 days, Landgasthof Hotel Linde reserves the right to make changes to prices or services.
4. Invoices are payable within 30 days of the invoice date without deduction. After this period, interest on arrears at bank rates will be charged.
5. The Landgasthof is entitled to demand a reasonable advance payment or security at the time of conclusion of the contract or thereafter.
6. A complaint about obvious defects can only be considered if it is made immediately upon provision of the service.
7. Delivered goods remain the property of the seller until full payment of all claims arising from the business relationship between seller and buyer.
§ 4 Cancellation by the customer
1. A customer’s withdrawal from the contract concluded with the Landgasthof requires the written consent of the Landgasthof. If this is not given, the agreed price under the contract is payable even if the customer does not make use of contractual services.
2. A free cancellation of the event is possible after conclusion of a legally binding contract up to two months before the event starts.
In the event of cancellation after this deadline, the following cancellation fees will be charged on the booked packages:
- up to 2 months before the event: free of charge
- up to 30 days before the event: 20% of the booked services
- up to 15 days before the event: 50% of the booked services
- up to 2 days before the event: 80% of the booked services
- from 2 days before the event: 100% of the booked services
The Landgasthof reserves the right to claim any further damages in addition.
§ 5 Binding number of participants
1. Banquet events The final number of participants (divided into adults aged 12 and over, children under 12 and toddlers under 3) must be reported to the Landgasthof no later than 2 days before the event. After this deadline, the number of persons ordered will be charged.
2. Conference events The final number of participants must be reported to the Landgasthof no later than 2
days before the event. The number of participants reported at that time will be charged to the booker; absences due to
illness can no longer be taken into account. Even if participants pay the conference package themselves, absences will be charged to the booker. If
fewer than 20 people attend the conference or the registered number of participants falls below 20, a
room rental fee of €100.00 per day will be charged. If a larger room is required than would be sufficient for the number of participants, the full room rental for that room will be charged.
The optimal room allocation remains at the Landgasthof's
discretion, unless a written agreement was made in advance.
§6 Special notes for events
1. The orderer and organizer are liable for payment of any food and drinks additionally ordered by the event participants. For unpaid bills of event participants, the organizer / orderer is automatically liable, even if they refuse this from the outset. If the orderer is not simultaneously the organizer, both are jointly and severally liable.
2. The customer is fully liable to the Landgasthof for damages caused by him or his guests. Taking out any necessary insurance for brought-in exhibition, seminar, conference items or technical equipment is the customer's responsibility. The Landgasthof is not liable for lost, damaged or destroyed items. The Landgasthof may require proof of such insurance.
3. Insofar as the Landgasthof procures services, technical or other equipment from third parties for the customer, it acts in the name and on behalf of the customer. The customer is responsible for the careful handling and proper return of this equipment and indemnifies the Landgasthof against all third-party claims arising from the provision of this equipment.
4. Newspaper advertisements, invitations to job interviews or sales events generally require the prior written consent of the Landgasthof. If essential interests of the Landgasthof are thereby impaired, the Landgasthof may withdraw from the contract and cancel the event.
5. To prevent damage to ceilings and walls, the attachment of decorative material or other objects must be agreed with the Landgasthof in advance. The customer guarantees that in particular decorative material complies with fire safety requirements. The Landgasthof may require the presentation of a corresponding certificate from the competent fire protection authority.
6. No own food and drinks may be consumed throughout the entire Landgasthof Hotel Linde and its associated outdoor area. Exceptions must be agreed in writing with Landgasthof Hotel Linde (cover charge / corkage).
7. The Landgasthof accepts no liability for brought-in food, as the HACCP cold chain cannot be monitored by us. Food and drinks that remain (in particular at buffets) may not be taken home.
8. The event room is available to the organizer / orderer upon booking exclusively on the day of the event. Possible setup on the previous day or breakdown on the day after the event is only possible by arrangement and cannot be guaranteed. Fees may be charged for use of the premises outside the event times.
9. Please note that volume must be reduced or adjusted from 11:00 pm. From 00:00 a night surcharge of €250.00 per hour applies. Any booked packages remain valid.
§ 7 Withdrawal by the Landgasthof
The Landgasthof is entitled to withdraw from the contract extraordinarily for a materially justified reason, for example if
1. force majeure or other circumstances for which the Landgasthof is not responsible make performance of the contract impossible;
2. rooms are booked under misleading or false statements of material facts, e.g. concerning the person of the customer or the purpose;
3. the Landgasthof has justified reason to assume that the event may endanger the smooth operation of business, the safety or the reputation of the Landgasthof in public without this being attributable to the sphere of control or organization of the Landgasthof;
4. the organizer conceals that he is a political association. In the event of a justified withdrawal of the Landgasthof from the contract, the customer has no claim for damages.
§ 8 Official permit
1. The necessary official permit must be obtained by the organizer at his own expense, unless something else has been expressly agreed in writing. The organizer is responsible for complying with all relevant regulatory requirements. On request of the Landgasthof, appropriate proof must be presented.
2. The setting off of fireworks or firecrackers is generally not permitted. Exceptions must be agreed in writing in advance and approved by the Günzburg district office. In the event of any claims or lawsuits, the organizer or client will be held liable. The use of open flames (spray fire, sparklers, fireworks) in the premises is not permitted. Exceptions are table candles and tealights.
3. All music events must be reported in advance by the organizer to GEMA. The GEMA fees are payable by the organizer. The country inn is indemnified by the organizer against any claims by GEMA arising from unauthorised use of GEMA's or third parties' rights (e.g. due to failure to register by the organizer).
§ 9 Lost Property
No liability is accepted for lost property or left / forgotten items. These will only be sent on request and against reimbursement of costs. The country inn will keep the items for a period of 6 months. Thereafter, if the items appear to have value, they will be handed over to the local lost-property office.
§ 10 Overnight stays at Gasthof Linde
1. See the terms and conditions of Gasthof Linde.
2. The country inn is not liable for damage or other unlawful behaviour of the conference guest.
3. The conference guest who stays overnight at Landgasthof Linde pays his hotel bill directly to Landgasthof Linde.
§ 11 Final provisions
1. Should one or more provisions of these terms and conditions be invalid, this shall not affect the validity of the remaining provisions.
2. Amendments or additions to the contract, acceptance of the offer or collateral agreements must be made in writing to be effective. In addition, the statutory provisions apply.
3. Place of performance and place of payment is the registered office of the country inn in Günzburg. Exclusive place of jurisdiction - also for cheque and bill of exchange disputes - in commercial transactions is the registered office of the country inn.
4. These terms and conditions are an integral part of the contract for the event. The event agreement and these terms and conditions together form the event contract.
5. German law applies.
